Delhi Assembly Session: The series of disputes between the Delhi government and the Lieutenant Governor is not taking the name of stopping. A new dispute has now erupted between the Arvind Kejriwal government and the Lieutenant Governor regarding the assembly session. The Delhi government has called a special one-day session of the assembly on Monday after Chief Minister Arvind Kejriwal was called for questioning by the CBI in the Excise Policy case.

Registering his objection to calling a one-day special session, the Lieutenant Governor said, “I do not understand under which act and under what circumstances and under what provisions this session has been called.” In response, Saurabh Bhardwaj, Minister of Delhi Government, said, “I want to explain to LG Sahab, under Rule 17 of the Procedure and Conduct of Business in the Delhi Legislative Assembly, the Speaker has the right to ‘do any thing after the house is adjourned sine die’.” ‘time’ is the power to summon a meeting of the House.”

What else did Saurabh Bhardwaj say?

Saurabh Bhardwaj says that although according to the prevalent parliamentary practice, the speaker of the assembly calls the session of the assembly only on the recommendation of the cabinet. The House has not been prorogued and can be prorogued only on the recommendation of the Cabinet. Since there was no recommendation of the cabinet for prorogation, the speaker of the assembly thought it right to summon the house under rule 17(2). Along with this, he told that all the members of the Legislative Assembly have been informed in this regard and a copy of this decision has been sent to them.

It should not be called – LG

Earlier, on behalf of the Lieutenant Governor, regarding the one-day assembly session, it was said that this process does not follow the proper procedure. He said that it should not be called. The Lieutenant Governor says, “I fail to understand, under what circumstances and under what provision of the GNCTD Act, 1991, the second part of the Fourth Session (Budget Session) of the Seventh Legislative Assembly, instead of moving a motion for prorogation of the Budget Session, Day student has been called.”

‘Convening the session is within the jurisdiction of the Speaker’

Lieutenant Governor Vinay Saxena on Monday pointed out a serious procedural lapse on the part of the Aam Aadmi Party-led government in convening a one-day special session of the Delhi Assembly. He said that the special session has been recommended by the Delhi cabinet without any specific legislative work. However, taking the lead on behalf of the Delhi government, cabinet minister Saurabh Bhardwaj made it clear that convening the assembly session comes under the jurisdiction of the Speaker. According to Bhardwaj, on the advice of the cabinet, the decision regarding the Speaker is taken.
