LUCKNOW: Those accused of crime against women and children will not get anticipatory bail in Uttar Pradesh. The Uttar Pradesh government on Thursday tabled amendments in Section 438 of the CrPC to this effect.
As per the proposal, the objective of the amendment is to ensure prompt collection of DNA and biological evidence in rape and sexual offences and to prevent such biological evidence from being annihilated, to minimize the possibility of destruction of relevant evidence and to restrain the accused from causing fear or coercion to the victim and witnesses.
The UP government proposed amendment in the Section 438 of the Code of Criminal Procedure (Uttar Pradesh) to include offences under Protection of Children from Sexual Offences Act (Pocso) and offences relating to rape in the exceptions to the provision of anticipatory bail.
